Capital Funding TX provides non-recourse pre-settlement funding. Repayment is required only if your case resolves successfully with a settlement or judgment in your favor.
Funding is not a loan. It is an advance against potential settlement proceeds.
All funding approvals and amounts are made at our sole discretion.
You represent and warrant that:
You are at least 18 years old and legally competent.
You are a plaintiff in an active lawsuit.
You are represented by a licensed attorney.
You have provided accurate and complete information.
Capital Funding TX is not a law firm and does not provide legal, financial, or tax advice. You must rely on your attorney for legal guidance regarding your case.
Submitting an application does not guarantee funding.
We may contact your attorney and require cooperation to verify case details.
You authorize us to communicate with your attorney, law firm, and funding partners to process your request.
If your case is successful, repayment (including applicable fees and charges) will be made directly from your settlement or judgment proceeds.
If your case is lost, you owe nothing.
Your individual funding agreement governs repayment terms and will control if inconsistent with these Terms.
By submitting your information, you consent to receive communications from Capital Funding TX by phone, email, or SMS/text. Message and data rates may apply. You may opt out at any time.
Your use of our services is also governed by our Privacy Policy.
All website content, including text, graphics, logos, and designs, is owned by or licensed to Capital Funding TX. You may not copy, distribute, or exploit it without written permission.
To the fullest extent permitted by law, Capital Funding TX is not liable for indirect, incidental, consequential, punitive, or special damages.
Our maximum liability shall not exceed the total fees paid by you directly to us, if any.
We are not responsible for attorney performance, court delays, or case outcomes.
You agree to indemnify and hold harmless Capital Funding TX, its affiliates, officers, employees, and agents from all claims, damages, or expenses (including attorneys’ fees) arising out of:

Your breach of these Terms
Your provision of false or incomplete information

Case outcomes
Settlement amounts
Funding approval or timing
All decisions are based on underwriting evaluation and available information.
All disputes arising from these Terms or our services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA).
Arbitration shall take place in Houston, Texas.
You waive your right to a jury trial.
Each party bears its own costs and attorney fees, unless otherwise required by law.
You agree that any dispute resolution will be conducted only on an individual basis. You waive the right to participate in a class action, collective action, or representative proceeding against Capital Funding TX.
These Terms are governed by the laws of the State of Texas, without regard to conflicts of law principles.
If any provision of these Terms is found unenforceable, the remaining provisions will remain valid and enforceable.
We may modify these Terms at any time. Changes will be posted with an updated “Last Updated” date. Continued use of our services constitutes acceptance of the updated Terms.
